The Superior Court of Sports Justice of Football (STJD) applied, this Tuesday (28), a suspension to Internacional defender Victor Gabriel, conditioned on the return of Cruzeiro forward Gabriel Pec to training. The measure, which has a maximum limit of 180 days, was determined after the defender committed a serious foul during the Colorado's 2-1 loss to Cruzeiro, in a Brazilian Championship Série A match held in Porto Alegre on July 22.
The infraction occurred 15 minutes into the second half and resulted in a fracture to the Cruzeiro forward's tibia, who had to be taken off the field on a stretcher. After examinations, Gabriel Pec underwent a surgical procedure and is expected to recover in three to four months. The defender, who was sent off during the match, claimed during the trial that he had no intention of injuring his opponent, attributing the hard tackle to the state of the wet pitch.
The judgment was based on article 254 of the Brazilian Code of Sports Justice (CBJD), with the aggravating factor provided for in paragraph 3 of the same article. The application of this rule aims to prevent athletes who cause serious injuries from returning immediately to competitions, serving as a disciplinary and preventive measure for cases of prolonged sports absence.
The decision was made by the majority of the auditors, including Eduardo Xibe, Jorge Octavio Lavocat Galvão, and Aline Gonçalves Jatahy. The reporting auditor, Rodrigo Steinmann Bayer, presented a dissenting vote, defending only a six-match suspension, without the condition of the injured athlete's return.
The STJD's decision is not yet final, as there is still room for appeal against the applied punishment. The case drew attention due to the severity of the injury caused and the application of a sanction that links the defender's suspension time to the opposing player's recovery process.
