Digital influencers who advertise illegal betting platforms will be held tax-liable, the federal government announced this Friday (19). “If an influencer goes on a social network and advertises an illegal bet, in addition to all administrative sanctions from the SPA [Secretariat of Prizes and Betting], the Federal Revenue Service will charge Income Tax and also taxes such as PIS and Cofins", stated the Secretary of the Federal Revenue, Robison Barreirinhas.

The information was released by the Minister of Finance, Dario Durigan, and later confirmed in a video recorded by President Lula on social media. The announcement of the measure comes the day after an operation against a criminal scheme involving billion-dollar movements through illegal bets (recall more below). "Block for illegal gambling! Alongside the Minister of Finance, Dario Durigan, and the Minister of Justice and Public Security, Wellington César Lima e Silva, I signed a new measure today that guarantees the freezing of financial resources from illegal betting companies", says the president's post. "Once due process is completed, the blocked funds will be allocated to the National Public Security Fund and will reinforce the fight against the financial structures of organized crime in the country", the PT member detailed. Durigan explained that the Ministry of Finance and the Ministry of Justice will block, administratively and preventively, resources originating from games called "irresponsible" by the government, that is, from platforms that operate irregularly. The rule signed by the president this Friday (19) defines the procedures to carry out this freeze and the rules for sending information that will assist in the investigation and seizure of assets from these operators — resources that may be allocated to the Union. In practice, when there are indications that a company is exploiting betting irregularly, the Secretariat of Prizes and Betting of the Ministry of Finance may notify financial institutions to freeze funds linked to the activity. ➡️After the freeze, an administrative process will be opened to investigate the case and decide whether the amounts will be confiscated and transferred to the Union. ➡️If, at the end of the administrative process, the irregularity is confirmed, the Office of the Attorney General (AGU) may appeal to the Court to request the confiscation of the funds and authorize the transfer of the amounts to the National Public Security Fund. According to the government, the procedure must follow the rules of administrative process, guaranteeing the right to defense and contestation for those under investigation, without affecting the rights of bettors. This communication will include direct contact with financial institutions, according to Durigan. "The Finance Ministry has been building this intelligence with the Secretariat of Prizes and Betting (of the department) and with the Federal Revenue Service.
